If our house goes into foreclosure, would my credit be affected? Also, if I buy another home in my name only, can the bank put a lien on my new house? And can they garnish my wages? Please? advise. I think this only works in certain states. Also in certain states you only have a 30 day window when you get a? notice of default. It is a big mess. We are in a recession, file chapter 7 and be done with it. This way the lender cannot sale the house and come after you for the deficiency balance.

It works very well for the one being foreclosed on because it proves the litigant/plaintiff did not enter into negotiations to keep it out of court. They did not attempt to satisfy this COMMON LAW REMEDY!
